New Legislation Would Affect RCFEs

Four bills introduced in the California state legislature would have an impact on residential care facilities for the elderly (RCFEs) if they are passed into law. 

AB 261 (Chesbro, D-Eureka) would prohibit  RCFEs from requiring advance notice for terminating an an admission agreement  upon the death of a resident. The bill would further prohibit charging any fees once all the personal property belonging to the deceased resident is removed from the living unit. LeadingAge California has secured amendments that address equity model CCRCs.

AB 364 (Calderon, Ian, D-Whittier) currently only includes community care facilities, but will be amended to increase the licensing visit frequency to once every two years for RCFEs. The current minimum frequency is once every 5 years. These amendments to include RCFEs in the bill are expected to be taken on April 2, 2013 when the bill is heard in the Assembly Human Services Committee.

AB 462 (Stone, D-Scotts Valley) would require all RCFEs that serve six or fewer residents to install sprinkler systems by January 1, 2016.

AB 581 (Ammiano, D-San Francisco) would prohibit officers and employees of a licensee from retaliatory actions, such as threatening eviction to a resident on the basis that he or she initiated or participated in filing a compliant, grievance or request for inspection with the department, local ombudsman, or state ombudsman.
