Home Care Licensing Legislation Resurfaces This Year

The push to license private home care services continues in 2013 with the introduction of two competing bills again this year. Last year, SB 411 (Price) and AB 899 (Yamada) were considered by the Legislature and would have required the Department of Social Services to assume oversight responsibilities of home care. The sponsor of SB 411 was SEIU and AB 899 was the California Association for Health Services at Home (CAHSAH).  SB 411 was successful in making it out of the legislature only to be vetoed by Governor Brown. The Governor objected to the institutional changes and costs the bill would have imposed in the period of the state’s financial uncertainty. 

This year, labor and home care providers are again competing on the issue with two new bills: AB 322 (Yamada, D-Davis) and AB 1217 (Lowenthal). Both measures would require aides to comply with certain licensing requirements, including: background clearances, TB tests, and  evaluations. AB 1217, however, adds additional requirements such as requiring DSS to maintain an internet website that lists aides, their employer, and geographic location, and status.
